By signing up to the Cirque Colors Affiliate Program you are agreeing to the following terms and conditions.
Definitions
"Affiliate" - The business, individual listed above, or entity participating in the Affiliate Program, or that displays Cirque Colors' Products and/or promotions on its website, or other means, using a coupon code in exchange for receiving a Commission Fee from Cirque Colors for sales directly resulting from such display.
"Affiliate Site" - The Affiliate's website which displays Cirque Colors' Products and/or promotions. This includes, but is not limited to, social media accounts on platforms such as Instagram, TikTok, Facebook, Twitter, Snapchat and Pinterest.
"Cirque Colors' Products" - All Products that are available for purchase from Cirque Colors through cirquecolors.com.
"Commission Fees" - The amount Affiliate will be paid for each Qualified Purchase by a Referred Customer that you refer to Cirque Colors pursuant to the terms of this agreement.
"Qualified Purchase" - A sale of Cirque Colors Products by Cirque Colors on cirquecolors.com to a Referred Customer.
"Referred Customer" - Each new and unique customer referred from Affiliate through a coupon code that makes a Qualified Purchase.
“Unique Affiliate URL” - The link provided to Affiliates by Cirque Colors which must be used to qualify as a Referred Customer.
“Coupon Code”- The code provided to Affiliate by Cirque Colors which must be used to qualify as a Referred Customer.
Earning via Code and Affiliate Unique URL Link
URL Link: On acceptance of the terms and conditions Affiliate will be supplied a Unique Affiliate URL to share and gain Commission Fees from. To be eligible to earn a Commission Fees, the user must click-through a Unique Affiliate URL and make a Qualified Purchase from cirquecolors.com. This link will be provided in the BixGrow dashboard and is customizable.
Code: Affiliate will also be supplied with a 10% off coupon code to share and gain Commission Fees from. To be eligible to earn Commission Fees, the user must redeem the 10% off coupon code and make a Qualified Purchase from cirquecolors.com.
Max commissionable sales is 10% on one order, even if a customer uses both the link and the coupon code to checkout, Affiliate will earn 10% commission on net sales of that order. This agreement will begin when Affiliate is approved for the program. If no Referred Customers make a Qualified Purchase with the coupon code or link, Affiliate will not earn a Commission Fee.
Fees & Payment
The Commission Fee is 10% of Net Sales made through the Unique Affiliate URL and coupon code. “Net Sales” shall mean Cirque Colors’ gross sales (the gross invoice amount billed to customers) of Products, less any discounts and further, less any bona fide returns.
If the user should cancel or return their order the Commission Fee for that user will reflect that change.
Affiliate Fees will be paid only on the coupon code and on the link that is tracked and reported in the affiliate system. The visitor must have cookies enabled to be able to track the Affiliate ID.
Affiliate commissions are paid on the 2nd Friday of the month, 30 days after the conclusion of the preceding month. (i.e. Affiliate would be paid for any January commissions on the 2nd Friday of March). Affiliate Fees are calculated based on the USD prices and will be paid in USD. Cirque Colors agrees to direct payment of the Affiliate Fees under this agreement to Affiliate.
All Affiliate summary details will be visible on the BixGrow App. They will provide the number of purchases, the conversion rate, gross sales revenue and Commissionable Sales.
Term and Termination
To join the Affiliate Program, you need to submit an application and receive approval. The agreement will commence once you accept the Terms & Conditions and are officially approved for the program.
Either the Affiliate or Cirque Colors may terminate this agreement at any time. Should the Affiliate choose to terminate, please contact marketing@cirquecolors.com
In order to stay enrolled in the program, the Affiliate must actively share their code and URL link at least twice per month on their chosen platform
The Affiliate may not use the Affiliate Program to earn Affiliate Fees on their own purchases.
Any complaints received due to misuse of this program will result in the termination of the agreement and forfeiture of the accumulated and unpaid portions of the Commission Fee.
Cirque Colors reserves the right to modify these terms at any time.
Any violation of these terms may result in termination or suspension from the Affiliate Program and loss of any outstanding payments earned during the violation.
Qualifying Sites
We reserve the right to refuse any site entry into the Affiliate Program based on site content. Sites that do not qualify for the Affiliate Program include sites which: Promote sexually explicit materials; Promote violence; Promote discrimination based on race, sex, religion, nationality, disability, sexual orientation, or age; Promote illegal activities; List coupon codes or discounts that were NOT officially provided to them by us; Infringe or otherwise violate any copyright, trademark, or other intellectual property rights of the Company.
Important notes
Product gifting is not included in the affiliate program
Cirque Colors reserves the right to change the affiliate fee structure at their discretion or disqualify Affiliate Fees earned through fraudulent, illegal, or questionable sales or marketing methods.
All fees are exclusive of all taxes, charges, levies, assessments and other fees of any kind imposed on the Affiliate’s involvement in this agreement and shall be the responsibility of, and payable by the Affiliate
Content
Cirque Colors reserves the right to organically share affiliate-generated content on its official social channels, including but not limited to Instagram, TikTok, YouTube, and YouTube Shorts. Affiliate will tag @cirquecolors in their content when applicable.
Confidentiality
Any information communicated by Cirque Colors to the Affiliate regarding the Commission Fee total, Commission Fee percentage, and all and any information on products before release, including images, shall be kept confidential and not be disclosed to any third party, without the prior consent of Cirque Colors for the duration of the Term, except where such information: (i) is in the public domain, or (ii) is information which was in the possession of the Affiliate prior to receiving it from Cirque Colors other than by the Affiliate’s breach of its obligations under the Agreement, or (iii) is information which the Affiliate or its advisors are required to disclose by law or a court of competent jurisdiction. Conversely, Cirque Colors undertakes that any information or data relating to the Affiliate that is communicated or to which it has access in the framework of the negotiations between Cirque Colors and the Affiliate shall be subject to the same restrictions as regards disclosure to any third party.
